Sale Policy

The following Sale Policy exclusively applys to sales made by Monting.fr. This Sale Policy is to be applied exclusively between the company Monting 25 avenue d’Italie 75013 Paris France and any person visiting or making a purchase on the website www.monting.fr. Our products are new. This Policy excludes any other Policy, in particular the policies that are applied in the stores.

Every internet user can read our general sale Policy on the website www.monting.fr. Changes may occur regarding these general sale policy. The Policy to be considered is the one that is online when proceeding the purchase. When making a purchase, the client accepts this Policy.

When Monting accepts a client’s order, Monting sends an order confirmation to the client. The client has to check the order confirmation and immediately advise Monting if there are any inaccuracies or mistakes. Otherwise, Monting will deliver the product as mentioned in the order confirmation which will stand for the agreement of the client.

ARTICLE 1 - PRICE

Our product prices are expressed in euros all taxes included (VAT and other taxes), except shipping cost. Our product prices are public prices. For orders that do not come from Metropolitan France, custom taxes and local taxes are to be paid by the receiver. Every order, no matter which country they come from, are to be paid in euros. Prices are subject to change without notice, however the products are billed referring to the price that was showed online when orders are registered.

The order confirmation and the bill indicate the price that the Customer has to pay. Monting.fr is the owner of the products until Monting receives the total amount of their price. We ship the products after the payment is completed.

While Monting.fr strives to provide accurate product and pricing information, pricing or typographical errors may occur. Monting.fr checks the prices before shipping any order. If the correct price is lower than the price posted on the website, Monting.fr applys the lower price and send the items. If the correct price is higher than the price posted on the website, Monting.fr cancels your order and notifies you of such cancellations, except if you choose to accept the order with the new price.

ARTICLE 2 - ORDER

The contract information is presented in French and translated in English for your information. The contract information will be confirmed latest before the shipping. Please note that there may be certain orders that we are unable to accept and must cancel, especially if there is a problem with the client regarding the payment of a previous order.

As Monting receives an order from a client, the order is considered to be ferm and definitive.

For your safety, we verify carefully any payment by credit card. We may verify if all the information that we have match. Monting may require a copy of the ID of the buyer and a document proving the address of the buyer, for any payment by credit card. These measures are efficient means to prevent any misuse of your credit card.

Any change of order for any reason, specially regarding the items or the delivery time, have to be made by written request and are only possible if accepted by Monting.

ARTICLE 3 - VALIDATION

You declare that you read this general sale Policy and that you accept it before proceeding to your order. The validation of your order means that you accept this general sale Policy.

Except proved otherwise, the data registered by Monting.fr is a proof of all the transactions made by Monting.fr and its clients.

ARTICLE 4 - AVAILABILITY

As long as our products and prices are visible on our website, they are valid, as long as they are in stock.

In case an item is out of stock, Monting will inform the client as soon as possible and will advise a new delivery time.

In this case, the client may cancel his order and Monting will reimburse the amount paid. Delivery times are mentioned as an indication and Monting cannot guaranty them. Regarding the products that are not in stock in our outlets, our offers are valid under the condition that they are available at our suppliers.

In these cases, Monting will inform you regarding the availability of the products when you are making the order. As these information come from our suppliers, mistakes or changes may occur. If an item is not available after you made an order, Monting will indicate a new delivery time as soon as possible by any means, as soon as the suppliers inform Monting. In this case, the client may cancel his order and Monting will reimburse the amount paid.

Monting.fr will reimburse a client either by crediting his bank account, or by check, within 30 days from the date of the payment of the client.

If an item is not available, Monting.fr can deliver another item equivalent in quality and price, if the client agrees with it.

In case the suppliers of Monting do not accomplish their tasks, Monting can cancel a paid order or part of it, and therefore must reimburse the client of the amounts paid.

ARTICLE 5 - SHIPPING

Products are shipped to the address that you indicated while making the order. The shipping times that are indicated are average times and refer to processing and shipping times for Metropolitan France.

In case items have different delivery times because of their availability, shipping time is based on the longest time. However, Monting.fr may ship items separately. Shipping and processing cost will be billed once. Monting.fr cannot be responsible for the consequences of any delivery delay.

The buyer cannot ask for damages claim, deduct or cancel his order, if the shipping time is over passed. In case of delay, you will receive an email.

If a pack or product is missing or damaged or not regular, the client must specify it on the delivery bill before signing any document.

In case of order by bank transfer or postal money order, we will proceed the order after reception of the payment. Consequently, the delivery times are valid from the day we receive the bank transfer or the postal money order. Therefore they can be changed compared to the delivery times indicated at the moment that the client made the order.

Shipping costs are indicated in the table on our website. Monting.fr can change shipping prices anytime, yet the shipping costs that are billed are the ones that are indicated on the website when the order is registered. The shipping cost that the clients have to pay is indicated on the order confirmation and the bill.

ARTICLE 6 - PAYMENT

The total amount of your purchase is due in advance.

We accept the following payment options:

We must receive any bank transfer or postal money order within 8 days, otherwise the delivery time cannot be ensured. Monting will then advise the new delivery time. If Monting does not receive the bank transfer or the postal money order within 8 days, Monting automatically cancels the order.

If the payment is delayed for a sale, the payment must occur at the date indicated on the bill. There are no discounts for anticipated payment. Except if agreed otherwise, if the payment is late, Monting will require the immediate payment of every amounts due by the client, no matter the payment methods. Penalties for being late are 1,5 times the legal rate applicable at the deadline of the bill. Every month that has begun is payable. Monting will bill an amount of 15 euros per file as a penalty clause.

In addition, Monting.fr may postpone or cancel any order in process, if the client does not respond to a formal notice. The amount of the late-payment interests can be deducted of any special discount that Monting.fr would have agreed on.

ARTICLE 7- REFUND

You can ask for a refund within 7 days after receiving your order according to the conditions mentioned in articles 8 and 9. Monting.fr will decide the reimbursement method that is by credit on your account or by check sent to the name of the client who made the order and to the billing address. The cash on delivery method will be rejected every time.

ARTICLE 8 - Return policy

You can return an item within 7 days after receiving your order. You have to pay the shipping of the items that you return. Monting will only reimbursement the price of the items (i.e. the shipping price will not be reimbursed). Items should be sent to MONTING 25 avenue d'Italie, 75013 Paris France in their original packaging, with complete accessories (manuals…), in perfect condition and with a copy of the bill.

If items returned are incomplete, damaged, spoiled or dirty, Monting will not take them back.

According to the law, Monting will pay back the price of the item (except the shipping price) within 30 days after receiving the returned goods.

ARTICLE 9 - CONFORMITY OF PRODUCTS

We will exchange products that are defective or do not correspond to your order. In this case, please ask for the exchange of the items in a written demand and send the items back. Monting will not refund the shipping price that you may pay to return items if you use any other return process than the one advised by Monting. Monting.fr will then change the items. You must make this request with 7 days after your receive the order. Any request past this time will not be accepted.

You can benefit from the warranty regarding hidden defects. This article does not prevent you from benefiting of the conditions of our return policy (article 8).

Our website is secure: we use the SSL encoding and we strengthened the encryption of the data regarding the payment methods.

Every text, commentary, work, drawing, and image published on monting.fr is reserved as infringement of copyright and as intellectual property for the entire world. Therefore regarding the intellectual property law, only a private use of the content of the website is allowed. Any total or partial copy of the website is absolutely forbidden.

ARTICLE 13 - RESPONSABILITY

The products we propose are in accordance with the French law. Monting.fr cannot be held responsible for non respect of the law in the countries where the items are shipped. You are responsible for checking the local rules regarding the importation or the use of the products that you want to order.

Pictures are showed as an illustration. You may read the description of the products to learn their specificities. In case of doubt, or if you want more information, please contact us.
Monting.fr cannot be held responsible for mistakes between the product specifications and its representations and/or the sale policy.

If there are links on Monting.fr that point to other websites, Monting.fr cannot be responsible for the content on these websites after the activation of the links. We will not be held responsible in case of delay if products are not in stock at our suppliers.

In case of purchase for professional use, Monting.fr will not be held responsible for indirect damages because of the purchase on Monting.fr, operating loss, profit loss, chance loss, damages, or expenses.

ARTICLE 14 - GUARANTY

Every watch bought on Monting.fr is guaranteed 2 years from the date written on the guaranty. During these 2 years, the brands will repair any manufacturing defects when the watch is delivered and any failure for free.

However, the guaranty does not cover:

This contract is subject to French law.

The language of this contract is the French language.

In case of suit, the French court is the only one competent.

ARTICLE 16 - PERSONAL INFORMATION

Monting.fr does not share your personal information with anyone. Monting uses your information for the fulfillment of your order and marketing purposes (personalized newsletter that you may receive or personalized website according to your interests).
However, if you access Monting.fr from partner websites that are identified as partners, your information may be communicated to those partners.

In order to know what information these partner website may have filed, we advise that you contact the partner website that you come from. If you do not want your information to be filed, please inform us at our address bellow. Consequently, regarding the information technology and freedom law of January 6th 1978 you have the right to access, change, and oppose to your personal information.
